DATA PROTECTION AND Privacy Policy

1. Introduction

This Privacy Policy applies to all the products and services provided by PopulationCouncil Consulting Pvt. Ltd. and its affiliates (collectively referred to as “PC Consulting” or “We”) accessible through its website, www.mquad.org. The term “Services” in this policy encompasses all products and services. Please read this policy carefully to understand our views and practices concerning Customer’s Personal Data and its treatment.

2. Definitions       

Customer: The user with an account on www.mquad.org, utilizing the platform to create and host surveys. 

Personal Data: Any information associated with an identified or identifiable natural person (referred to as a “Data Subject”). 

Data Fiduciary: The individual, solely or in collaboration with others, determining the purpose and means of processing Personal Data. 

MQUAD: PC Consulting’s proprietary platform that enables Customers to create and host surveys and collect and analyze Survey Data from Survey Respondents.

Survey Data: Responses obtained from surveys hosted by Customers on the MQUAD platform. 

Survey Respondent: The individual who receives and responds to a survey initiated by the Customer on the MQUAD platform.

3. Collection of Information

We collect the following information from our Customers: 

Registration Information: When Customers register an account on MQUAD, we collect Customer Personal Data including email addresses, additional contact details, IP addresses, location data, device information, OS details, and other information reasonably necessary for facilitating account creation as part of Service provision.

Billing Information: For payment transactions on MQAUD, we collect billing details from Customers, including billing addresses and financial/payment information in accordance with applicable laws. 

Usage information and Account settings: In the course of using our Services, we may collect usage information related to Customers, such as visited web pages the Customer visited, language preferences, etc. 

Personal Data of Survey Respondents: Customers using our Services may upload contact details, including Personal Data, of Survey Respondents to MQUAD for the purpose of collecting Survey Data from Survey Respondents. In such cases, the Customer acts as the Data Fiduciary and we process this data in accordance with the agreement between us and the Customer.

4. Use of Customer’s Information

To the extent permitted by applicable law, we use the Customer’s Personal Data that we collected to perform our contractual obligations, Services, and other legitimate interests that are detailed below:

(i) Process Customer’s registration with our Services in accordance with our legitimate interests to operate and administer our Services. This includes sending emails, invoices, receipts, and notices of delinquency. 

(ii) To communicate with Customers about their accounts and provide customer support, aligning with our contractual obligations.

(iii) To enforce compliance with our Terms of Service and applicable laws. 

(iv) To personalize Customer’s experience and deliver content and product offerings aligned with their interests. 

(v) To improve our website or services for better customer service.

(vi) To administer surveys.

(vii) To quickly process transactions.

(viii) To investigate and prevent unauthorized access to the Websites and the Services, and other prohibited activities. 

(ix) To carry out other legitimate business and lawful purposes.

(x) Legal requests: We may use Customer’s Personal Data to comply with legal obligations, such as responding to a court order, a request from a government authority, or to prevent fraud.

(xi) Notifications: We use Customer’s Personal Data for communications required by law or to notify changes to our terms, this privacy policy, or changes (permanent or temporary) to our products or services. 

(xii) Marketing: We may use Customer’s Personal Data to share information about improvements or additional features of our products and services. This information may be sent to the Customers who have consented to receiving it or in accordance with our legitimate business interests. Customers have the option to stop receiving marketing communications from us at any time. 

5. Who do we share Personal Data with?

We will only disclose Customer’s Personal Data in the circumstances described below:

• Our service providers: We may disclose Customer’s information to our third-party service providers. 

• Professional advisers: We may need to disclose Customer information to our professional advisers, including our lawyers, auditors, etc. 

• Compliance with legal obligations and enforcement of our rights: We may also have to disclose Customer’s Personal Data to comply with our legal obligations and enforce our legal rights.

6. Updating Customer information

If Customers wish to update, amend, correct, or request the deletion of their Personal Data, they may do so by changing the account settings or by emailing us at info@mquad.org.

7. Rights as a Data Subject

To the extent, PC Consulting acts as Data Fiduciary with respect to the Personal Data of the Customers, the Customers shall have the following rights: 

7.1. Right to Access: Customers may update, amend, correct, or request deletion of their Personal Data.

7.2. Right of Erasure: Customers may request erasure of their Personal Data. However, we may not be able to accommodate the request for erasure where it is necessary for that information to be retained for record-keeping purposes or compliance with our legal obligations.

7.3. Right of Rectification: Customers have the right to have their inaccurate or incomplete Personal Data rectified.

7.4. Right to Object: Customers have the right to request that we stop processing their Personal Data for marketing purposes. 

7.5. Right to Withdraw Consent: Customers have the right to withdraw consent at any time when we are relying on consent to process their Personal Data. This will not affect the lawfulness of any processing carried out before consent is withdrawn.

8. How long do we keep Personal Data?

 8.1. We will retain Customer information for as long as their account is active or as needed to provide our products or services, or otherwise fulfil the purposes described in this policy, including satisfying any legal, accounting, or reporting requirements.

8.2. Survey Data: Customers have control over the management of Survey Data and can delete it from our online systems or download it to their own systems at any time.

9. International Data Transfer

PC Consulting may process and transfer Customer Personal Data to its Affiliates and data centres outside the country of Customer’s residence in compliance with applicable Data Protection laws. As a Customer, you acknowledge and agree that your Personal Data may be transferred to and processed in countries outside your residence. These countries may have data protection laws that differ from those in your jurisdiction, and your personal data may be subject to access by law enforcement and other agencies in those jurisdictions. We take measures to protect the data and maintain its confidentiality and integrity during transfer.

PC Consulting places the utmost importance on the data privacy of its Customers and commits to comply with applicable laws. 

11. Personal Privacy

Customers are entitled to exercise data protection rights as per applicable data protection laws, to the extent we act as the Data Fiduciary of Customer Personal Data.

12. Security

 We adhere to the highest security standards to ensure the confidentiality and integrity of Customers’ Personal Data.

13. Amendments to Privacy Policy

PC Consulting reserves the right to make changes to this Privacy Policy periodically. The revised version will be posted on the website along with the effective date. In case of material changes in the way we collect/handle Customer information, we will notify Customers via email. Continued use of our Services implies consent to the amended Privacy Policy.

14. Unsubscribe From Our Communications      

Customers can unsubscribe from our marketing communications by clicking on the “Unsubscribe” link provided at the bottom of the emails, updating their communication preferences, or sending an email to info@mquad.org.
